Terms of Service

Effective: March 2026

These Terms of Service ("Terms") govern your use of the AuditAble accessibility compliance platform ("Service") operated by AuditAble, Inc. ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Service Description

AuditAble provides automated website accessibility scanning, reporting, and monitoring services designed to help organizations evaluate conformance against WCAG 2.1 Level AA criteria. Our platform scans publicly available web content, identifies potential accessibility barriers, and generates reports with remediation guidance.

2. Important Disclaimers

Please read these disclaimers carefully:

  • Not Legal Advice: AuditAble is a technology tool, not a law firm. Our reports and findings do not constitute legal advice. You should consult with qualified legal counsel regarding your specific compliance obligations.
  • Automated Coverage Limitations: Our automated scanning technology evaluates a subset of the 50 WCAG 2.1 Level AA success criteria; each report states the exact number of criteria that scan evaluated, and criteria that were not evaluated are reported as Not Evaluated and are never counted as passed. Many accessibility requirements can only be fully evaluated through manual testing and human judgment. A clean automated scan does not mean a website is fully accessible.
  • Not a Compliance Certification: AuditAble reports are not compliance certifications. No automated tool can certify full WCAG conformance. Our reports identify issues detectable through automated analysis and should be used as one component of a comprehensive accessibility program.

3. Acceptable Use

By using AuditAble, you agree to:

  • Only scan websites and web content that you own or have explicit authorization to scan
  • Respect robots.txt directives and Crawl-delay headers on target websites
  • Not use the Service to interfere with or disrupt any website's normal operation
  • Not attempt to circumvent rate limits or scanning restrictions
  • Not use scan results to harass, threaten, or initiate bad-faith legal action against website owners
  • Not resell or redistribute scan results without our written permission
  • Provide accurate account information and keep it up to date

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Billing and Payment

  • All payments are processed securely through Stripe
  • Subscription fees are billed in advance on a monthly or annual basis
  • Government organizations may pay via purchase order (PO) with Net 30 terms upon approval
  • Refunds are available within 30 days of initial purchase if the Service does not meet your needs
  • We will provide at least 30 days' notice before any price increases
  • Failure to pay may result in suspension of Service access

6. Intellectual Property

Our Property: AuditAble, including its scanning technology, algorithms, user interface, documentation, and branding, is the intellectual property of AuditAble, Inc. and is protected by copyright, trademark, and other intellectual property laws.

Your Data: You retain all rights to your data. We claim no ownership over the content of websites you scan or the data you provide through your account.

7. Data Ownership

All scan results, reports, and findings generated for your organization belong to you. You may export, share, and use them as you see fit. We retain an anonymized, aggregated copy of scan data for the purpose of improving our scanning algorithms and maintaining industry benchmarks. This aggregated data cannot be used to identify your organization or specific websites.

8. Limitation of Liability

To the maximum extent permitted by law, AuditAble shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless AuditAble, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Service Availability

We target 99.9% uptime for our platform. Scheduled maintenance windows will be communicated at least 48 hours in advance and will be conducted during off-peak hours when possible. We are not liable for temporary unavailability due to maintenance, force majeure events, or circumstances beyond our reasonable control.

11. Termination

Either party may terminate the Service agreement with 30 days' written notice. Upon termination:

  • You will have a 30-day export window to download all your data, reports, and findings
  • After the export window, your data will be securely deleted from our systems
  • Any prepaid fees for unused service periods will be refunded on a pro-rata basis
  • We may terminate your account immediately for material violations of these Terms

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.

13. Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days' advance notice of any material changes via email to the account holder. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
